1. Introduction
These Terms of Service ("Terms") govern your access to and use of CaptRead, including the CaptRead Windows application, digital theme packs, the website captread.com, and any related services. CaptRead is operated by Benjamin, an independent one-person software project based in Denmark.
By purchasing, downloading, installing, or using CaptRead, you agree to be bound by these Terms.
2. Definitions
"CaptRead" refers to the Windows application, theme packs, digital content, and website. "Digital Content" refers to theme packs, individual themes, and any downloadable assets. "License Key" refers to the activation code delivered upon purchase. "Merchant of Record" refers to Lemon Squeezy, who processes all payments. "User" refers to any individual accessing or using CaptRead.
3. Digital Content and Delivery
CaptRead theme packs are digital content delivered immediately after purchase. Delivery is considered complete once the license key is issued to the email address provided at checkout.
CaptRead does not guarantee delivery if incorrect or inaccessible email information is provided by the user.
4. Right of Withdrawal (EU Consumers)
Under EU law, consumers typically have a 14-day right of withdrawal for digital purchases. This right does not apply once you consent to immediate delivery of digital content.
During checkout, Lemon Squeezy will present and record your explicit consent to waive the withdrawal period. Once consent is given and delivery occurs, the right of withdrawal lapses.
If you do not consent to immediate delivery, your digital content will only be delivered after the 14-day withdrawal period has passed.
5. Pricing and Payment Terms
- One-time
- 799 DKK for the Universe Pack (Galaxy, Forest, Neon, Solar) or the Elements Pack (Earth, Water, Fire, Air); 999 DKK for the Crystal Pack, Arcana Pack, Abyssal Realms Pack, or Art Deco Royale Pack; 199 DKK per individual theme.
- Monthly rental
- 99 DKK/month per theme; 349 DKK/month for the Universe Pack or Elements Pack; 399 DKK/month for any other collection. Subscriptions renew automatically until cancelled — access continues until the end of the paid period.
- Payment processing
- All payments are handled exclusively by Lemon Squeezy. CaptRead does not receive or store payment information, billing details, or personal data associated with purchases or donations.
6. License Grant
Upon purchase, you receive a non-exclusive, non-transferable license to use the CaptRead theme(s) on your personal device(s). Redistribution, resale, sublicensing, or sharing of license keys is prohibited.
CaptRead retains all intellectual property rights to the software and digital content.
7. User Responsibilities
You agree not to: reverse engineer, decompile, or modify CaptRead; circumvent licensing or activation mechanisms; share or distribute license keys; use CaptRead for unlawful purposes; or attempt unauthorized access to systems or services related to CaptRead.
Violation may result in termination of your license without refund.
8. Service Availability
CaptRead is provided as a standalone application. While efforts are made to ensure stability, uninterrupted access cannot be guaranteed. Updates may be released at any time without prior notice.
CaptRead may discontinue features or content at its discretion.
9. Third-Party Services
CaptRead relies on third-party services including Lemon Squeezy (payment processing, license delivery), Google Analytics (website analytics), and CookieYes (cookie consent management). These providers operate under their own terms and privacy policies. CaptRead is not responsible for outages, errors, or data handling performed by third-party providers.
10. Donations
Donations are voluntary contributions and do not constitute a purchase. No digital content or license key is delivered in return.
Donations are final once made, except in cases of technical error or unauthorized payment. If such an issue occurs, contact captread.app@gmail.com.
11. Limitation of Liability
To the fullest extent permitted by law, CaptRead is provided "as is" without warranties of any kind, express or implied.
CaptRead is not liable for: indirect or consequential damages; loss of data; incompatibility with specific hardware or software; issues caused by third-party services; interruptions, bugs, or errors; or user misuse or unauthorized modifications. Liability is limited to the amount paid for the digital content.
This limitation does not apply where liability cannot legally be excluded or limited under mandatory EU or Danish consumer protection law — including your statutory right to digital content that conforms to its description under the EU Digital Content Directive (2019/770). Nothing in this section removes rights you're entitled to by law.
12. Warranty Disclaimer
CaptRead does not guarantee: continuous availability; error-free operation; compatibility with all Windows versions or hardware configurations; or future updates or feature additions.
Digital content is provided without warranty beyond what is required by applicable law.
13. Governing Law
These Terms are governed by the laws of Denmark. Any disputes shall be resolved under Danish jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your own country of residence as an EU consumer.
14. Modifications to Terms
CaptRead may update these Terms at any time. Changes take effect once published on captread.com. Continued use constitutes acceptance of the updated Terms.
15. Termination
CaptRead reserves the right to terminate licenses in cases of fraud, abuse, or violation of these Terms. Termination does not entitle the user to refunds unless required by law.
